User Agreement

Welcome to La Crosse Builders Exchange, Inc. hereinafter referred to as “LAXBX”. Use of this service constitutes the Member’s agreement to abide by the rules and regulations set forth in this User Agreement, as promulgated by the management and Board of Directors, including acceptance of the following terms and conditions:

For purposes of this Agreement, “planroom” shall mean both the physical plan room located at 709 Gillette Street, Suite 2, La Crosse, Wisconsin, and the online plan room. The plan room contains information about construction projects, bidders and other matters that may be of interest to Members of LAXBX. Efforts have been made to ensure the accuracy of the information reported. LAXBX offers no warranty, express or implied that any of the reported information is accurate. LAXBX relies on project information obtained from third-party sources and is not responsible for their accuracy. The best source of information for projects is the actual plans and specifications maintained by the issuing authority.

LAXBX expressly disclaims all warranties, including warranties of merchantability and fitness for a particular purpose, in connection with the use or operation of the online plan room contents. LAXBX will not be liable for any losses, including lost data, information, profits or any other incidents of consequential damages that may be sustained or arise out of the use, operation or ability to use the plan room. In consideration for the privilege of using the plan room, Members hereby release LAXBX, its officers, employees and any third-party vendors from any and all claims arising from the use of this service.

The information contained in the plan room is provided for the exclusive use of LAXBX Members; replication other than for estimating purposes is strictly prohibited. LAXBX reserves the right to control or limit access to the plan room. Sharing of usernames and passwords with non-Members is strictly prohibited. Access may be denied at any time for any reason.

United States copyright laws prohibit the distribution or copying of copyright materials without proper authorization. LAXBX does not tolerate any use of the plan room contents which may in any way violate United States’ copyright laws. Members must report any copyright infringement to the LAXBX staff. If, in its sole discretion, LAXBX determines that any project information is in violation of copyright laws, LAXBX will delete that information. Any Member who, without authorization, loads copyrighted information on the online plan room shall indemnify and hold LAXBX harmless from any and all resulting claims and liability.

LAXBX does not warrant software or services provided by others in any form, nor does LAXBX warranty that any services are guaranteed for any purpose. LAXBX endeavors to provide accurate project information. However, errors or omissions may occur and Members are advised not to rely completely on the accuracy of that information. LAXBX disclaims any and all liability arising from inaccuracy or incompleteness of any such information. Project information is to be used only for the purpose intended by the providers of this information.

Providing your email address acknowledges your agreement to receive email communications from LAXBX. All Membership Applications are subject to formal approval by the LAXBX Board of Directors.

Physical Plan Room -
The plan room is available to Members of LAXBX weekdays from 8 am to 4:00 pm, except certain holidays. Any persons using the plan room must be employed on the permanent staff of a LAXBX Member. Each person entering the virtual plan room via computers at the physical plan room must sign the plan room daily register. Plan room privileges may be suspended or revoked for any Member not in good standing with LAXBX, or whose representatives abuse the plan room.

Payment

Payments are non-refundable. Membership privileges and plan room services and products will be terminated if accounts become past due. To remain a member in good standing, payments must be made on or before the due date. Failure to do so will result in the cancellation of all LAXBX member services, and deactivation of access to the virtual plan room. LAXBX reserves the right to terminate any Member for outstanding account balances or for non-payment.
